Facts:
Defendant
challenged an order of the jury session of the Boston District Court
(Massachusetts), which conducted a trial de novo and entered judgment on a
jury's guilty verdict on charges of operating under the influence (OUI) of
intoxicating liquor, Mass. Gen. Laws ch. 90, § 24(2)(a) (1975), and negligent
operation of a motor vehicle, Mass. Gen. Laws ch. 90, § 24(1)(a)(1) (1982).

The Massachusetts
Court made the following holding:
- Under Mass. Gen. Laws
ch. 90, § 24(1)(a)(1) (1982), whoever, upon any way or in any place to
which the public has a right of access operates a motor vehicle while
under the influence of intoxicating liquor, or of marihuana, narcotic
drugs, depressants or stimulant substances, all as defined in Mass. Gen.
Laws ch. 94C, § 1 shall be punished.
- In a prosecution for
operating a motor vehicle while under the influence of intoxicating
liquor, the Commonwealth must prove beyond a reasonable doubt that a
defendant's consumption of alcohol diminished the defendant's ability to
operate a motor vehicle safely. The Commonwealth need not prove that the
defendant actually drove in an unsafe or erratic manner, but it must prove
a diminished capacity to operate safely.
