Defendant
appealed his convictions for manslaughter and operating a motor vehicle while
under the influence (OUI) of intoxicating liquor, which had been entered in Boston
(Massachusetts), claiming that the trial court erred in denying his motions for
required findings of not guilty, for suppression of evidence, and for a new
trial.

Court made the following holding:
- The standard which the
court applies in reviewing the propriety of the denial of a motion for a
required finding of not guilty is whether the evidence, read in a light
most favorable to the commonwealth, was sufficient to satisfy a rational
trier of fact of each element of the crime beyond a reasonable doubt. The
court will consider the evidence at the close of the commonwealth's case
and at the close of all the evidence to determine whether the motion
should have been granted.
- Mass. Gen. Laws ch. 263,
§ 5A provides in part that a person held in custody at a police station,
charged with operating a motor vehicle while under the influence of
intoxicating liquor, shall have the right, at his request and at his
expense, to be examined immediately by a physician selected by him. The
police official in charge of such station, or his designee, shall inform
him of such right immediately upon being booked, and shall afford him a
reasonable opportunity to exercise it.
